Just playing devil's advocate here... but
How do you define what he did?
What do you consider rape?
To borrow from old Billy Shakespeare, "A rose by any other name smells as sweet."
In my personal opinion, regardless of what the courts ruled, he is a rapist, because he raped that unconscious girl.

I think more than likely he sexually assaulted her(based on what is known). I do feel the punishment for sexual assault was lacking but do think they are separate crimes in a legal sense.
Now as far as on a personal level, someone who sexually assaults someone is no better than a rapist.
