Oh, I agree completely.
Unfortunately, "should be" doesn't remove the reality of the situation. The world is not a perfect place, for that reason we (and her by extension) need to exercise good judgement.
It's simple. If I was to use the situation to describe some moral lesson to someone; it would be.
"Do not rape or sexually assault someone and do not place yourself in an avoidable and vulnerable situation where you are at risk of being raped or sexually assaulted."

The girl exercised very poor judgement. Those are simply the facts of the situation. She doesn't get a free pass on her incompetence because she was a victim of an avoidable situation.

Actually you can be charged with anything the cops want to charge you with. The DA decides if the charges are valid.
