If Alton didn't stop resisting when the cop near his head had a gun drawn and pointed point blank at his chest area, and told him "Don't move!! I swear MF'er"...

Resisting arrest does NOT justify deadly force. Resisting arrest does justify additional charges for resisting arrest (which is not punishable by death - even after due process has been completed).
The guy may well have been a TPOS, but the ONLY justification for lethal force would be if Sterling pulled his gun. 2009's arrest means absolutely nothing when determining if Sterling pulled his gun.
