When we found out him running out of money, he was already several weeks past the contract completion date,
Before you fired him did you ask him if him had a plan on when him would be through?
Hmmmmm

I had a bid for $23,000 worth of work done on my house. When it was time to pay I disputed a few items and ended up paying $19,500. I didn't a penny till all the work was done. I got 5 bids and went with the middle one.

This is precisely why you need to have a lawyer file suit on your behalf.
If things really are as you say, there shouldn't be any reason why you can't get a judgment against the guy. Actually collecting it may be a little tricky, depending on the solvency of the guy, but if you file the judgment, it will always be enforceable.
Get a lawyer, my man.

NEVER PAY THE CONTRACT AMOUNT UP FRONT!!!!!
Just go ahead and count hat money as gone. You wont get it back.

and we had paid in full because of the 3% late penalties.
No. You didn't "pay in full".
Bottom line is this. You aren't going to get money back that you didn't actually pay in. Move on and do a better job vetting your contractors next time.
