So if this guy hadn't had a drop but was still driving 118 MPH (allegedly) would that make him any less culpable.
I struggle with the extent to which what are, ultimately, accidents, should be charged criminally.
And what happens in a lot of these, if the perp has means, he makes big civil settlement with the victim's family and the vic's family goes asks DA to go easy criminally.

Going 118 MPH on a city street, or any roadway, isn't an accident. You have to do that on purpose.
