If it's just you and your brother, and the estate is not too large, I would suggest looking in to an Affidavit of Heirship. All you need is a disinterested third party that knows your dad's marital and family history. They're very easy to draft and really serve the same purpose as a probate, assuming your father didn't have a bunch of specific bequests to different people.
