Again. I know you to be level-headed and I usually come down squarely on the side of most of these "grey area hookups" being just that. Two drunk people fricking and the girl feeling bad about it later. *If she's being truthful* she was blackout drunk and wanted to get away badly enough to wonder into someone else's room, the common living room, and a public hallway buck arse naked.

Don't stick your dick in a girl that drunk. It's not that hard.

I agree it is a terrible situation, but I don't know how to fix it. Perhaps there should be some sort of lesser charge that applies in these cases.

That being said, I'm not naïve enough to believe that the guy is always innocent. More often than not, the guy is going to be the one who initiated the sex. If it can be proven you're the instigator, you should be held responsible for your actions, drunk or not. The issue is whether or not it can be proven.
