If you're AT&T you should be fine. Don't change your contract though.

My understanding is that as long as you stay with the same type of device and tell them you want to keep unlimited data, they can't take it away.
We have a business account with several unlimited plans and the only downside is an employee with an iPhone can't switch to an android and vice versa. I guess it's something AT&T is using to try to nitpick and find any way they can to take away unlimited.

I've upgraded a lot of times. It doesn't effect your plan IF you tell them "I want to keep my existing plan. " and I'll repeat it again "I want to keep my UNLIMITED data plan. Do you understand?"

Unless you still have a 3gs, you've updated on the unlimited plan
