You messed up. You should have filled it up. Own your mistake and don't do it again.
I made a similar decision two weeks ago and I swear my car was 98% full (just below the F on the gauge). They charged me like $18.00 to fill up what was probably $2.00 of gas.
Tough shite. Own it and don't don't do it again. Don't use AMEX or whatever as a cop out for your mistake.
You signed the contract and didn't fulfill your end of the deal. Why should the car company have any sympathy (Note: They shouldn't).

I didn't start this thread for some teachable moment in fiscal responsibility, especially from some long-winded blowhard. Objectively, a company charged me for about $50 more in gas than is physically possible unless there was a hole in the tank. That is all.
