The hit and run guy is legally and morally responsible for what he did, and should be punished in accordance with the law.
But honestly, I travel La. 30 all the time and see bikers travelling north or South all the time. I shake my head wondering when one of these people will get hit.
The speed limit is 55 and heavy trucks and cars routinely drive 60mph. That's no place for a biker even though it is legal for them to be there. It's just too dangerous.
I am vigilant and try to give them a wide birth when I pass them by so that I do not mess with their "space" so to speak or startle them.
And being out there at night compounds the problem.
I don't have the answer, but bikers need to be more than careful. Personally I wouldn't do what they do.

When the wife was training for the ironman she needed a place to do long rides or connect her to river road south of Lauberge so she'd hop on the shoulder of Nicholson and ride opposite of traffic so she could see if she needed to ditch the bike. Of course, she was doing this in full daylight too.
