It's the refs! If the offensive player initiates the contact, it shouldn't be a foul. Harden is great at this and gets the calls. He's playing to what the refs are calling. Is it annoying, yes.
Just like the hack a Shaq. It's part of the game. If the league wanted to do something about it, they would have done it 10-15 years ago when it started
