So if two nearby bars are competing for business, one could send workers to the rival bar, call police to report that the other bar is allowing smoking, then all light up when the police arrive outside. The rival bar gets fined and the smokers get a wag of the finger.

This sounds like another dumb law to try and correct a dumb law that hasn't even started yet.
