That's kind of like saying a guy who was pulled over for speeding is responsible when the dipshit cop does not pull over far enough, and gets clipped by another motorist, killing said motorist.
That does not excuse the police officers though.

It appears they were separate apartments. So, he wasn't "there."

So, you get in a wreck due to negligence and some is killed due to a cop losing control of his car responding. You are responsible for that persons death?
