Don't be a douche and delete all your inbox, sent emails and archives. That will just fuel the fire.
Do your final expense report, make sure your PTO/vacation time is correct with HR, then hand them the keys, laptop and credit cards and walk away.

All these tough guys in here sound like they've never been sued. . Whether you can win isn't the question. Avoiding being sued is the way to win. . I don't know your situation but is your new employer willing to cover your legal fees if you get sued? Are you even in a position to ask?
One more: I'm sure you will be able to perform your new job without making use of any confidential info from your old one right?

Right
He definitely doesn't want to get sued, frivolous or not it will be a drain. Especially if the old employer want to try to make an example of him but knows he won't win
He needs to visit with HR of the new company and they will manage the process for him to protect them and himself.

Fred your exactly right. I'm trying to avoid any legal action all together. I haven't spoken to the new company about this yet.
I never had any intention of using the previous employer stuff to preform the other job. I was hired just like any other person, that would have to go through the training for the job.

Fin I suppose this is okay if they don't ask. But don't lie or mislead either. . Injunctions are a lot easier to get when I can show the former employee lied about his plans. Makes judges very suspicious. Where there's smoke. On the flip side an honest employee who answers questions about plans honestly or at worst says I'd rather not say is much better off when shite hits the fan.

HAd the same thing happen to a coworker. They went through his computer and made sure he didn't copy any info but that's it.

That's exactly what I did. They asked and I told them the truth. I have no information or computer for them to go through.
