You are being pedantic, but I have a slow day so I will respond.
No, a person is either guilty or innocent of a crime. A trial "finds" them guilty; it does not create the situation to come about which a person is guilty. In other words, a court recognizes guilt.
Of course you have believe in an objective truth to follow that line of reasoning.
