I googled up a Beer Advocate thread that doesn't produce any decisive (read: legal) answers, but it does basically express the difficulty in recreating something to a "T." There were some interesting anecdotes from brewers in there along the lines of a group of people with the same ingredients and same recipe submitting the "same" beer to a blind panel and the panel having wildly dissenting views about it. Run-on sentence. Oh well.

So many things go into making a beer. It is, after all, a living thing. Hell, most breweries can't even replicate their own beers when they start out. It takes getting to know a system and understanding your process to replicate beers that taste the same from batch to batch.
