Minor's mortgage question

i am trying to purchase a house and just found out it has a minor's mortgage against it.anyone have experience with this ?
how long to be resolved etc.

A minor's mortgage is security granted by a tutor for the performance of their duties as a tutor for some minor child. It is a general mortgage over all property in the parish where it is recorded. I believe they prescribe two or three years after the minor's 18th birthday, by release by Court order or possibly by the minor (who is now over 18). The court will order it be released if sufficient security is given in lieu of the minor's mortgage. In other words, the tutor will have to post a surety bond of some sort or a specific mortgage on another piece of property. How long it takes to clear up varies greatly. It can be as simple as cancelling it if it has prescribed or it can be difficult because the tutor cannot otherwise provide security. The title company and/or the attorney handling the tutorship could give you a better idea if they know what they are doing.

thanks that helped a little … lol … just never heard of it before and lawyers office was closing so they were no help

If you mentioned it to a random Louisiana lawyer there is probably a better than 50% chance they don't know what it is.
