I think most all were thrilled or dumbfounded by the Byrd signing. The ones suggesting it most were prolly those who had the least understanding of the cap. So if it was such a great move, why didn't we see it or even call for it? That was the point here- why it was not only a great move but one that had a lot of logical basis that we generally overlooked.
