I'm just trying to explain to you that even though a 12 weeks leave may be legally available to me it's not really available unless you have a shitty job.

well what was your point?

You said if you took 12 weeks off and did the same job you did before and were fired you would have a great lawsuit.

Two men work the same job, same pay, and are both very good employees. Company has to cut back for whatever reason. Lets say reduction of force. Do you think the company would keep the guy who shows up to work on a more consistent basis than the one who doesn't?
