Generally "viability of the fetus" is considered to start at around 24 weeks. This is key because "viability" (i.e., the ability to survive outside the womb) is the cutoff between when abortion rights are generally upheld and restricted (if the fetus cannot survive outside the womb, the right to an abortion is upheld; if it can survive, then the right may be restricted).

Although the means necessary may be extreme to do so, a twenty week old fetus surviving is well within the realm of possible today.

Good point. Of course, this is somewhat like "adulthood" (it really differs from person to person) but at some point there has to be a cutoff.
What is interesting is that only four Justices are needed to grant cert, which means that no more than three were willing to hear the case. So it appears that the 20-week rule won't be changing anytime soon.

The Supreme Court didn't block shite. They just refused to grant the writ.
The could be a million reasons to deny it that don't include endorsing the ruling below.

But misdiagnosis of gestational age, if ultrasound is not performed, is a very real possibility. It is certainly possible to mistake a 24wk pregnancy for one at 20 wks.
