Yes and I wouldn't limit it to race and gender. Companies should be able to hire and fire over:

Hair color
Weight
Tit size
Bama Fans
Regional Accents
Tattoos
Age
Marital Status
Religion

If I discriminate to the extent that the public becomes annoyed then I will suffer by market forces.
