All of those tweets are from yesterday from their support's twitter. This was at the same time Phil Harrison was contradicting what they were saying. Microsoft's most recent stance is they will release details later and you'll be able to sell games back to physical retailers.

Well they seem to be pretty adamant with their denials on something that's supposed to be known at a later date, even to the point of attempting to have articles removed that talk about it.

You would always be able to. The fee doesn't counteract that action, just makes it annoying because you have to pay a fee to activate. That is unless they change the policy before launch (which has to happen after all the negative press, right?)
