If the guy was making threats then he wasn't exactly "innocent" either. I'm not justifying the fight, but the lawyer has eluded to the fact that the guy may have been instigating.

Rape and bar fights are two totally different types of crimes.
In my experience bar fights are usually a two sided event. Rape on the other hand is unprovoked.

So dumb. I had a buddy and this very thing happened to him. I was there that night and the guy he hit shouldn't have been hit, but he was running his mouth to my buddy for some time before he got punched. It was like poking a rabid dog with a stick pretty much. I wasn't at the Hill thing, but not many people go around hitting others unprovoked. The guy my buddy hit was an obnoxious douche and got exactly what he was asking for. My buddy still should have taken the high road and not let the guy under his skin, but because he hit the guy in the face, cut him, and the guy needed stitches, he was charged with battery.

I understand what you're saying and what you're not saying. You're not comparing rape with this assault but rather comparing the assumed innocence of a victim in any case.
That said, never use the word rape. It tends to set off the overly sensitive among us.
