Devils Advocate question: What if Hill just grazed him and did no harm??? It was stated by those who saw the tape that the victim went down after the second guy hammered him...
Then his only crime was intent which is not a crime.

At Common Law, an intentional act by one person that creates an apprehension in another of an imminent harmful or offensive contact.
So intent could harm could still be seen as assualt even if he just grazed him.
