Anything over a certain wattage would require a permit(from FCC I think). We have some at work that uses a repeater tower and they will only reach 5 miles or so. And they weren't cheap. Course this all depends on terrain and other things causing interferance. If you are in Montana with little other radio traffic from hill to hill you would get more distance. In a city environment you would be limited.

Yep..the signals are traveling horizontally so they will be affected by depressions/elevations and physical obstacles.
