don't believe it even gets to a jury. DA will NOT accept 2nd degree battery charges. curious to see if Nathan Fisher looks into past cases where freaking DNA was taken for 2nd degree freaking battery! i'm VERY familiar with homicide investigations and DNA buccal swabs and what not...and i'm still trying to figure out the whole JJ DNA sample

DA is not touching it.

Going to a grand jury. What is interesting about that part of the process is the defendant does not get to produce and evidence as well as the standard to proceed being lower than beyond a reasonable doubt. Grand jury indictment does not indicate a conviction by any sense of the imagination.

I thought it was the DA and the police who determined that there was enough evidence to arrest?? Didn't they meet Thursday night?
