The law on this is very much on California’s side stemming from from the Clean Air Act, which generally prevents states from setting their own vehicle emissions rules but includes a special exception for California due to its historic smog problems. Under this law, California can adopt stricter emissions standards if it receives a waiver from the EPA. Since the EPA has granted more than 100 waivers since the 1970s and courts typically defer to EPA decisions, California’s standards are usually considered legal when a valid waiver exists.
