You gotta love the fact that the Attorney suing the Trump admin, Katyal (clerck under Kegan and Obama guy) is arguing conservative points of view to the SCOTUS.
This is just fricking funny:
So Atilo asks:
So he set this guy up perfectly. Justice Alito asked Katyal about his argument that the Trump administration’s tariffs violate the “nondelegation doctrine,” a legal theory that prevents Congress from delegating its legislative powers to other branches of government. The doctrine has been pushed in recent years primarily by conservative legal groups.
The exchange:
LMAO!
So let's get this straight.
1- They admit Trump can do this anyway. That there are many other ways to do this.
2- But at the same time, should they win, removes the next DEM the authority to use this for things like climate change etc..... WHICH they have threatened before.

This is just fricking funny:
quote:
Katyal says that if the court rules against the government, the administration has plenty of other trade authorities it can turn to. That’s true. As we’ve written, there are a range of other authorities that allow the president to impose tariffs that could be just as sweeping
So Atilo asks:
quote:
whether the Supreme Court should address President Trump’s authority to impose tariffs under authorities other than the law at issue in the case.

The exchange:
quote:
“I wonder if you ever thought that your legacy as a constitutional advocate would be the man who revived the nondelegation argument?” Justice Alito asked of Katyal, who served in the Obama administration.
quote:
Mr. Katyal was quick to respond. “Heck yes, Justice Alito. I think Justice Gorsuch nailed it on the head when saying that when you’re dealing with a statute that is this open-ended — unlike anything we’ve ever seen — to give the President this power.”
LMAO!

I dont know why you cant see this.

*potential avenues to try this

Did you miss the Biden student loan ruling, or something?
And oral arguments in this case have no precedential value, or value outside of this setting (and its minimal in this setting, mind you)

I do love the fact that Trump is losing badly on this. Gorsuch and Kavanaugh are clearly not buying it. I think it will be 6-3 against.

Trump has played this masterfully. Liberals have no idea how bad last night will be for them in the long run.

Didn't the administration attorney also respond to Gorsuch that climate change would be a legitimate reason for exercising this authority?

An emerging theme, from several justices, is that the president’s concededly broad power to shut down trade generally may include the lesser power to impose tariffs. That echoes the administration’s position.

This makes total sense.
If he can completely halt trade with other countries (which would tremendously and adversly impact consumers, importers, exporters, etc.), then how does he not have the power to merely make trade a little more expensive?
