ATLANTA, GA, NOVEMBER 5, 2024 – At its May 7, 2024 meeting, the Georgia State Election Board (SEB) decided that Fulton County’s 2020 election problems warranted them to monitor its 2024 election with teams mutually agreed upon by the SOS, SEB and the county. However, the county quickly hired its own choice of monitors without SEB consent thus voiding the agreement. They picked former SOS legal counsel Ryan Germany and the Carter Center, neither of which found any significant 2020 problems. The county then filed suit to prevent the SEB from selecting any monitors, alleging the SEB had no legal authority to force monitors upon them. However, the county acknowledged the SEB still has authority to impose up to $5,000 per violation for the 340 process violations found to date.
Fulton County’s actions in 2020 diluted the votes of most Georgia voters, who are now left with the prospect of the county monitoring itself for the 2024 election. Worse yet, those the county chose to employ were instrumental in what amounts to a cover-up of the 2020 irregularities. Germany claimed an audit monitor filed a false affidavit after four senior Fulton County poll managers and two monitors found counterfeit mail-in ballots in Fulton’s hand count audit on November 14, 2020. He also claimed a Coffee County Election Board member was lying when he told a House committee that they could get no help from the SOS office after the voting system was unable to produce correct results during multiple attempts at a 2020 recount. Germany opposed any forensic examinations of the voting system despite several 2020 counting failures.
The Carter Center, which monitored the Fulton hand count audit, never reported the counterfeit ballot discovery. They failed to detect that the audit tally sheet upload point to the SOS office consisted of a single individual or that the county refused to allow the upload point to be monitored. They further failed to detect that most counties had no record of their own results or the audit’s broken chain of custody in allowing the SOS to exclusively report audit results for the counties. The Carter Center report concluded the hand count audit “…confirmed the original results of the presidential election in Georgia”. Gov. Kemp’s own study proved that claim false when it found over 6,600 votes were added to the audit to make the audit results match original results. These points and more were documented in a VoterGA letter to the SEB.
The deep severity of Fulton County’s 2020 election irregularities began coming to light on July 8, 2022, when the SEB received one of several complaints regarding how the county handled its 2020 election. In total, the complaint alleged that up to 58,924 votes were certified without any source justification. Problems included missing ballot images and tabulator tapes, double counting of ballots and backfilling of ballots to resolve election result discrepancies. On May 7, 2024, Secretary of State (SOS) investigators and SOS legal counsel Charlene McGowan presented the case to the SEB and argued there were no significant problems. On July 9, 2024, the SEB heard three experts shred the SOS investigation on behalf of complainants Joe Rossi and Kevin Moncla who were not allowed to testify previously despite Georgia law. O.C.G.A. 50-13-13-3 On August 7, 2024 the SEB voted to refer the allegations for an independent investigation.
At 5pm last Friday, the county elections office announced it would accept absentee ballots over the weekend at four branches and then sent a private Email to the branches instructing them not to allow public observation. A rapid public outcry forced them to rescind the decision which violated Georgia law. O.C.G.A. 21-2-215 (d).
