At the end of the day it is always the individuals arse on the line.
A business takes on the liability of the product or service they're offering. The onus is, and should be, on them to perform their work correctly.
It's the same concept as the way the law views drug dealers vs. consumers: The dealer (the business) is the, "expert." It's their arse on the line, and the ruling on jail time versus the two reflects that.
