If no other criminal record, at the very least an attorney would arrange a plea that will allow it to drop off his record after six months. Know that the DA does not want to make the arresting officer come to court and the officer doesn't want to. Usually the asst. DA will be seeing the file right before trial is to begin and would have to call the officer to come in, and figure out how to prove the case. They would rather cut a deal, get a fine, and let it go away in a few months.
