I could see if they had already determined that it not a case of whether or not the defendant could bear arms, then it was simply the unlawful nature of the arms themselves (lack of serial numbers) that's being determined. The 2nd A wouldn't apply if someone got caught with a fully automatic firearm, the '34 NFA would apply, and has already been determined to be Constitutional.
