It's not really consensual though. People signed them because they had to, to get the job. It's one thing to agree to certain bullshite while employed for someone, but an employer should not have any say once you've parted ways.

Non competes should only apply while employed.

Example: you work for a company that provides a service. You cannot compete against the company by offering the same service on the side to companies’ clients trying to undercut them.

But once your employment with someone is terminated, you should be able to do whatever

That’s the part of post and job perks, read the fine print and sign or don’t but you can’t renege.


Blows my mind that govt can outright outlaw this…..

I'm sure some of the people using this argument to support government's meddling into private contracts also supported the government's overreach during the COVID farce by saying that the people who got the jab to keep their jobs did it consensually.
