Then VW could close it, even if they closed the plant because of the union vote. The "no partial closures" rule is designed to prevent an employer shutting down one plant because it voted for a union as it would create a chilling effect on the other plant or plants. In the last five years, the NLRB order a plant reopened because of a partial closing (one plant closed, one plant open). The order to reopen was rescinded because it was unduly burdensome (the delay of appeals helped the employer).
The link below explains how it works. I'm not sure why I'm getting downvotes - I've practiced in labor law for 30 years + and have litigated numerous ULP cases, including some involving closures.

And the only one of 122 VW plants worldwide currently being operated without a CBA with the employees because VW prefers having a CBA with its employees...it is how they do business worldwide. VW was SHOCKED after the first vote failed in Tennessee because they preferred dealing with the UAW....they have said as much many times about their facility in Tennessee...THEY, VW Management, wanted a UAW contract in place...it is their preferred method of doing business, negotiating with a small number of people instead of thousands of individuals AND being able to tell the world that their employers are well compensated and have good benefits...I know the latter is simply sickening to far too many people but VW prefers being known as an employer that pays its production costs instead of low balling its workers. If you study the history of VW there is an obvious reason for their preference in this area....
