I don't want to get into the weeds on this because I am not licensed in LA and not a criminal lawyer. However, as I have said the timeline and events between the initial punch and the blow that resulted in death are incredibly important. The last facts posted (AFAIK still uncited) imply that there was some period of time where the "fight" was not ongoing and Matt and his crew seemed to have decided to go finish the matter. The time period and the chain them down/backing them down may have indeed shifted the right of self defense/defense of others to Repath. The video and witness statements about that period of time are incredibly salient and the whole case turns on facts that we simply don't have beyond inference.
Using my gut to fill in the blanks along with the specific phrases the police used in the report (as reported by WNRZ) suggests to me Matt and his crew screwed up the courage to go finish the matter and hunted them down in the bar. All this is simply a guess. We simply don't have enough substantiated facts to apply law to the final blow. Now if we had the video and all the witness statements we could probably do a lot better.
