You’re doubly correct. Texas will probably lose on the merits. So send them back now, and in as high a quantity as possible. Because the minute the district court rules against Texas on the merits, the law will be stayed by the District Court, Fifth Circuit, and SCOTUS before it’s eventually struck down.

Agree x3. The problem is that this can and should have long since been resolved by Congress.
Yet another example of every single political and social issue facing our nation being 100% the fault of Congressional inaction.

The executive branch could just enforce the laws already passed by congress. That would be a fantastic start.
