The idea that you can be subjected to injustice because you forgot to argue something at a lower court is pretty absurd. The courts are supposed to be about justice over procedure.

The law has evolved into a system that justifies itself.
Procedure, knowledge of the system, and willingness to twist the law writhing said system has become much more important than the protections the laws themselves were intended to provide.

Without procedure you have chaos. Navarro was a fool. He should have gone and answered every question with a "frick you, I'm not answering" If he had done that he would have fulfilled the subpoena and the Democrats could not have done shite about it.
