I didn't say that the top has to be taped. I said that if the shop tapes the straw to the top, it's not considered an open container. From what I've seen, most hand you the daiquiri then a wrapped straw.

Tape means nothing. It’s still not a rule for opened container. Daiquiri shops used to do that because they thought it was a technical way to get around it. It’s not. Neither is unopened straw.
