Serious question, in your opinion, should a drunk person be arrested for DWI if the police show up and that person is sitting in the driver's seat of a car parked on private property?
What about sitting in a car parked in your garage while drunk? Garage door open or shut?
What about driving a car on private property while drunk?
What about driving an ATV around the deer camp while drunk?
What about drinking in your home with the car keys in your pocket?
Trying to figure out the line here.

Yet there's a nearly 100% that you text and drive or at least have more than you'd care to admit. Which is just as dangerous if not more so than drinking and driving. The penalties for using your device and driving should be just as harsh as for DWI. Maybe more so.

i don't disagree, but i do have a bit (a very little bit) of respect for somebody who pulls over and says "nope. would rather sleep this off."
not saying that's what's going on here, but she had reclined and appeared to be sleeping
