Incorrect.
Privilege is an evidentiary exception created by statute that can (as was in this case) be determined not to apply. That does not mean the communication is not still subject to the confidentiality requirements of Rule 1.6.

I thought during the hearing they all basically said the confidentiality part didn't apply
