Here's my observations based on my watching of dozens of DUI arrests on the Tube.

1) You do not have to consent to the FST. The FST will help you in no way whatsoever, even if you're sober. I've seen people absolutely ACE the tests and still get arrested. It's pointless to participate.

2) Once you refuse, the Cop will make a judgement call on whether to arrest you based on his observations (alcohol smell, open container, slurred speech, etc.). If he suspects you of DUI already, then he's probably gonna arrest you.

3) Once at the station, the Cops will ask you to take a breathalyzer (the kind that sit on the desk and are admissible in court). If you refuse, you will lose your license for a set period of time (depending on your state's specific law). There is no way around this - you either blow or lose your license. Most states make this very clear in the law and there's really no loophole.

4) You will have to decide which penalty will hurt you most. A DUI or automatically losing your license for 6 months (or whatever it is). If you already have DUI's on your record, it is probably best to refuse and just take the license suspension. Keep in mind, that they can still charge you with DUI even if you don't do the FST and refuse to blow. But their case will be much weaker.

The best DUI videos are those of off-duty Cops getting busted for it. One of the Cops I saw was himself a DUI officer and had made hundreds of DUI arrests. When he got pulled over, he refused everything. In fact, he was pretty slick and was really good at stalling the officers so they couldn't get him back to the station quickly. I am not sure how good of a strategy this is as alcohol leaves your system VERY slowly. Stalling probably won't do much good unless you can do it for several hours (unlikely).

I do not drink and drive, so I've never had a DUI. All you baws that do are trashy.

If you burp, they are supposed to wait a 1/2 hour before testing at least in NC.

Some states will get a warrant for a forced blood test at a hospital.
