Has the statute been cited? I cannot find support for this. Does NY not have the equivalent of a devolutive appeal?

CCVP 5519 deals with the stay of enforcement during appeals and the filing of undertakings. I don't know if there is an option to not stay the judgment and appeal, but I presume that is of little utility in this matter as appeals can take years.
