When you are breaking the rules which he was and you are openly discussing it in the phone with another party that’s careless and stupid. The detail that it was the Feds is irrelevant. In some states you can record calls without the other persons consent or the guy he’s talking about on could have turned him or told a 3rd party that turned him in.
How he was caught is irrelevant he was caught which is pretty much the definition of being careless. Especially if as you claim everyone does it and does get caught.

how he was caught is very relevant and its not "pretty much the definition of being careless". you can be very careful and get caught and super careless and not be caught.
