Eh, nobody had the foresight to know that the game was going to be THIS huge, so there was little incentive to wait until post release.
If Nintendo had a strong case, I suspect they would have put a bullet in this thing when it was announced in 2021. They could have sued, gotten the assets, launched their own version of the game with actual Pokemon and made more money than they could count.
