I found it interesting the underlying law was passed in 1968 at the height of the counterculture movement/ law and order response.

That actually played a part in the analysis. There were few historical analogues from before then to justify it.

I actually don’t mind this one being struck down, especially in light of our evolving views of marijuana.

I’m more curious to where the line is on this historical analogue world we now live in.

Higginson’s concurrence touches on that and that Rahimi has been granted cert and hopefully we get a little further clarification from it about where the guideposts are.
