Well he pled guilty for one. Usually the incentive for a guilty plea is a reduced sentence.
Next it looks like the maximum term for what he was charged with (felony DUI resulting in fatality) is 20 years. So judge wouldn't even have the authority to issue a life sentence much less the death penalty. Can't have judges creating and adjudicating the law.
