Dershowitz keeps claiming this is a First Amendment case. It is not. The indictment specifically states Trump has a right to voice his opinion about the election, and even lie about the election if he wants to. Trump is not being indicted for statements made in his Jan. 6 speech.
The First Amendment does not protect your right to commit a crime. If your speech is part of a fraudulent conspiracy, you aren't protected.
I think the indictment might be a stretch on fraud against the US, but you can expect to hear more evidence as co conspirators get charged in superceding indictments.

The only fraudulent conspiracy to deny rights is the one Jack O. Smith has created. There has been a long line of those fraudulent conspiracies against Trump starting with Hillary's pee pee dossier and the Russia hoax.

So a unknown poster knows more than a Harvard law professor who just happens to be an expert on constitutional law. Read that slowly and you will see how stupid your post is.

If you were correct about this, Smith would not have manipulated Trump's comments when he quoted him in the indictment.
