same tempo, same sparse instrumentation, same drum snare sound. different melody. it's derivative for sure.

The songs definitely sound similar. You can sing "Let's Get It On" over the music to Sheeran's song, but I'm glad Sheeran won. It's not like it's almost exactly the same or even the same lyric-wise.
Robin Thicke lost in a similar case to Marvin Gaye's estate or whatever over that song "Blurred Lines" which really sounded much less like the Marvin Gaye song they were saying it sounded like other than having similar elements. The songs had totally different melodies. He got screwed.
