This. It's better to claim he's a criminal that gets away with it than actually arrest him and hold him. that's begging for both trouble and the creation of a martyr.

If they were smart (and that's a big if knowing what we know about the progressive sky screamers and the Biden admin), they would string this out until 2024. Yes, a lot of innuendo, but nothing actionable.

If Trump runs, and wins the nomination, then the day after to convention arrest him. Get a Democrat friendly judge to hold him without bail. Then you've got your Republican nominee sitting in jail and not able to campaign. Hammer the point that you can't vote for a criminal.

So at that point the Republicans are stuck. Stay with Trump and lose the votes of the dumbass suburban housewives who turn against him in 2020 again, or replace him on the ticket and lose all of your MAGA voters.

Pretty much becomes a shoe-in for Biden/Harris/whoever.
