Your insurance will cover your vehicle's damage, minus your collision or UMPD deductible. They're not going to pay for the torn up yard because you're not liable for that damage.

This would be out of collision, as Alabama does not have uninsured motorist property damage.

Damn, I hate to hear that. They were super nice folks and actually sitting on their porch at the time and witnessed the accident. The POS that caused the accident bailed on foot afterwards and ole Baw on the porch hopped on his 4 wheeler ran him into a corn field close by. A K9 sheriff had him screaming in about an hour. It was awesome!

State Farm did for me. I used my uninsured motorist policy to cover the damages and about 2-3 years later I received a check and letter stating that they had located and sued the car owner for the damages and returned my deductible.

This is exactly what I was asking about. I figured this would be best case scenario. I knew they would go after him for damages paid out but not sure if that would include my deductible. I was def not going to try and track down this POS for my $250 deductible.

I have had banks call me because the uninsured dude was trying to get a loan. Have had them roll the debt into the loan on judgments I thought were worthless.

They might try to chase down the guy, depending on how much they pay out. If you actually have the guy's info, they'll get a judgment against him and, at a minimum, ask DPS to suspend his license.

If the accident was not your fault, your UM rates should not be affected because you pursued a claim. If they are, file a complaint with the DOI.

If you were comparatively at fault for the accident, then depending on how much fault, it might affect your premium.

Thanks. Just curious, are you an Insurance Baw or a Law Baw? The reason I ask, is there any possible scenario where an adjuster can come up with his own conclusion that differs from the accident report?

Law Baw.

Yes. The adjuster is not bound by the accident report and any findings of fault by the LEO and can make his/her own fault determinations (of course, they should conduct an investigation beyond the accident report). Now, that's not gospel (the judge or jury is the ultimate fact finder), but unless you file suit (or go to arbitration if that's allowed/required in Alabama), that determination will control the handling of your UM claim (and any payments).
